Introduction & acceptance
These Terms of Service (“Terms”) govern your use of Isopace, operated by Marek Paňko, an independent entrepreneur (OSVČ) established in the Czech Republic (IČO 23702524, DIČ CZ0709066886). In these Terms, “we,” “our,” or “us” refers to this operator.
- By joining the waitlist, creating an account, or otherwise using Isopace (the “Service”), you agree to these Terms and to our Privacy Policy.
- If you do not agree, please do not use the Service.
02
What Isopace is
Isopace is a data-forward endurance-coaching service that builds and adapts training plans from your activity data.
- Early access. The Service is under active development and currently offered on an early-access basis. Features may change, be added, or be removed as the product evolves.
- Guidance, not a guarantee. Training plans and recommendations are informational guidance. Athletic outcomes depend on many factors outside our control, and we do not guarantee any specific result.
03
Eligibility & your account
- Age. You must be at least 16 years old to use the Service.
- Accurate information. You agree to provide accurate account information and to keep it up to date.
- Account security. You are responsible for activity under your account and for keeping your sign-in credentials and session tokens confidential. Tell us promptly if you suspect unauthorized use.
04
Health & safety disclaimer
Endurance training carries inherent physical risk. Read this section carefully.
- Not medical advice. Isopace provides training and fitness information only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for a qualified physician or coach.
- Consult a professional. Consult a doctor before starting or significantly changing any training program, especially if you have a medical condition, are pregnant, or are returning from injury.
- Train at your own risk. You are solely responsible for your training decisions. Listen to your body, and stop and seek help if you feel unwell, dizzy, or in pain. You assume the risks of physical activity.
05
Acceptable use
To keep the Service safe and reliable for everyone, you agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Upload activity data you do not have the right to share, or impersonate another person.
- Attempt to reverse engineer, scrape, disrupt, overload, or gain unauthorized access to the Service or its infrastructure.
- Resell or commercially exploit the Service without our written permission.
06
Your content & data
- You own your data. You retain ownership of the activity files, metrics, and race information you provide.
- License to operate. You grant us a limited license to store and process that data solely to provide and improve the Service, as described in our Privacy Policy.
- Connected services. Data obtained through optional integrations (Strava, Polar AccessLink) is handled per our Privacy Policy and each provider’s own terms. See our Privacy Policy.
07
Third-party services
The Service relies on third parties (such as Strava, Polar, cloud hosting, and email delivery).
- Your use of a connected third-party service is also subject to that provider's own terms and privacy policy.
- We are not responsible for the availability, accuracy, or actions of third-party services outside our control.
08
Availability, fees & changes
- Provided “as is”. During early access the Service is provided on an “as is” and “as available” basis, without any uptime or availability guarantee. We may modify, suspend, or discontinue features at any time.
- Fees. The Service is currently offered free of charge. If we introduce paid features, we will present the applicable pricing and terms before you are charged.
09
Disclaimers & limitation of liability
To the maximum extent permitted by applicable law:
- No warranties. The Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose.
- Limitation. We are not liable for indirect, incidental, or consequential damages, for loss of data, or for injuries or losses arising from your training or use of the Service.
- Your statutory rights. Nothing in these Terms limits any rights you have as a consumer under mandatory Czech law that cannot be lawfully waived.
10
Termination
- By you. You may stop using the Service and delete your account at any time; deleting your account permanently removes your data as described in the Privacy Policy.
- By us. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to others or to the Service.
11
Governing law & disputes
- Czech law. These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules.
- Consumer disputes. For consumer disputes that cannot be resolved directly, the competent out-of-court body in the Czech Republic is the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz).
12
Changes to these Terms
We may update these Terms from time to time.
- If we make material changes, we will update this page and, where appropriate, notify you before the change takes effect. Continued use of the Service after an update means you accept the revised Terms.
